Terms & Conditions (AGB)

1. Scope
These Terms and Conditions apply to all contracts concluded via the online shop studiosaramast.com between Sara Mast, Riesstraße 160, 8010 Graz, Austria ("Seller") and customers ("Buyers"). The version of these Terms in force at the time the contract is concluded shall apply.
2. Contracting Party, Conclusion of Contract
The purchase contract is concluded with Sara Mast. The presentation of products in the online shop does not constitute a legally binding offer, but rather a non-binding invitation to Buyers to order goods. By submitting an order, Buyers make a binding offer to purchase. The purchase contract is concluded once the Seller accepts the order via an order confirmation sent by email.
3. Prices and Payment Terms
All prices stated are final prices. As I am exempt from VAT under the Austrian small business regulation (§ 6 para 1 no. 27 Austrian VAT Act — Kleinunternehmerregelung), no VAT is shown.
Payment can be made via Shopify Payments or PayPal. The purchase price is due upon conclusion of the contract.
4. Delivery and Shipping
Art prints are produced and made ready for shipment within 1–3 business days. Delivery time thereafter takes an additional approximately 2–5 business days within the EU, or approximately 5–10 business days for non-European destinations (e.g. USA, Australia), depending on the destination country. For large-format, framed original artworks, shipping is arranged "upon request": after purchase, I will personally contact you to coordinate shipping method, cost, and timing individually, as these vary depending on destination country, size, and weight.
Shipping is carried out via Austrian Post, GLS, or DHL, depending on destination country and product size. For deliveries outside the EU, additional import duties/customs fees may apply and are to be borne by the Buyer, unless stated otherwise (see IOSS notice at checkout).
5. Retention of Title
Delivered goods remain the property of the Seller until paid in full.
6. Warranty
The statutory warranty provisions apply. For consumers, the warranty period is two years from delivery of the goods.
As original artworks are handmade, one-of-a-kind pieces, slight variations in color, texture, or grain compared to the product image (e.g. due to differences in screen display) may occur. This does not constitute a defect.
7. Right of Withdrawal
The statutory right of withdrawal for consumers applies. Details can be found in the separate Right of Withdrawal notice (see below, also linked at checkout).
8. Liability
I am liable without limitation for intent and gross negligence, as well as for injury to life, body, or health. For slight negligence, I am only liable for breach of material contractual obligations, limited to the foreseeable, typical damage.
9. Applicable Law
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers habitually resident in another EU member state, mandatory consumer protection provisions of that state remain unaffected.
10. Final Provisions
Should individual provisions of these Terms be invalid, the validity of the remaining provisions shall remain unaffected.
